Consumer protection in Portugal

Portuguese consumer law protects a consumer, or consumidor, when dealing with a professional business or fornecedor. The rules cover many purchases, services, contracts, advertising practices, and unfair terms. Consumers should receive clear information about the product or service, total price, important conditions, and the identity of the business. Hidden charges and misleading descriptions can create legal problems for the business. Goods and digital or service contracts must generally meet the agreed description and ordinary quality expected for that type of transaction. When something is defective or does not match the agreement, the consumer may have legal remedies. Distance and off-premises contracts can have withdrawal rights in some situations. Exceptions exist, so the nature of the product, service, delivery, and contract matters. A receipt, invoice, order confirmation, guarantee document, photograph, and message can help prove the transaction. A bank record alone may show payment but may not describe everything that was agreed. Portugal uses the Livro de Reclamações, including an electronic form in relevant cases, as a formal complaint channel for many businesses. A complaint should describe the facts clearly and state the solution requested. If direct contact does not solve the problem, consumers may use an appropriate entidade de resolução alternativa de litígios or bring a case before a court. The correct route depends on the sector, business, and type of dispute. Consumer rules have limits, especially for private sales, business-to-business purchases, fraud investigations, and highly regulated services. A consumer remedy does not remove the need to act carefully or preserve evidence.
