Civil law in Angola

The Civil Code of Angola is based on Decreto-Lei 47 344/1966, which entered into force in Angola in 1968 and has since been amended. Other important frameworks include the Código da Família (Lei 1/88), the Código de Processo Civil (Decreto-Lei 44 129/1961, with later amendments including Lei 6/21), the Lei de Terras 9/04, the Código do Registo Civil, the Código do Registo Predial, the Lei do Notariado and rules on mediation, legal aid and legal practice. Civil-law questions often depend on formal records and the correct institution. A Conservatória do Registo Civil handles civil-status events such as birth and marriage registration. A Conservatória do Registo Predial records interests in registered property, while a Cartório Notarial authenticates or formalises acts that require notarial form. Land matters also involve the municipal administration and the Instituto Geográfico e Cadastral de Angola (IGCA). SIAC centres provide several registry, identification and related services where available. A written contract is strongly advisable because oral agreements can be difficult to prove. Contractual freedom operates within the law, public order and good morals; breach may lead to damages, fulfilment or termination where the legal conditions are met. Property transactions require particular care because land is originally State property and private parties generally hold statutory land rights, such as a right of superficies or a concession, rather than unrestricted ownership. Title documents, cadastral records, the matriz predial and the registo predial serve different purposes and should not be treated as interchangeable. Family and inheritance matters rely heavily on marriage, birth and death records. The Código da Família regulates marriage, união de facto, parent-child relations, adoption, parental responsibility, maintenance and divorce. Succession opens at death and may follow the law, a will or another legally admitted title; reserved-share rules can limit what a person may dispose of. Customary or informal arrangements may influence practice, but they do not automatically replace formal registration or legally recognised transfer. Civil liability may arise from culpable non-performance of a contract or from an unlawful act that causes damage. Damage, causation and proof determine the claim, while special rules may apply to areas such as traffic, insurance, professional activity or public bodies. Civil proceedings normally begin at a Tribunal de Comarca and may proceed to a Tribunal da Relação and then the Tribunal Supremo, depending on the procedure and appeal rules. Enforcement requires an enforceable title and may involve seizure and sale of assets under the applicable procedural rules. Access remains fragmented. Court fees, registry and notarial charges, lawyer fees, expert costs and processing times vary according to the act, dispute, province and institutional capacity. Legal aid under Lei 15/95 may include fee relief, deferred costs and lawyer services, subject to the applicable requirements. Mediation and conciliation under Lei 12/16 can provide a voluntary alternative, but the enforceability of an agreement depends on its form and any required approval. Current legislation and local practice should be checked before relying on a deadline, tariff, procedural step or institutional requirement.
