Employment in Costa Rica

Employment in Costa Rica is usually called empleo, and an employment contract is a contrato de trabajo. The relationship generally exists when a person performs work personally, receives payment, and follows another party’s direction. Contracts may be indefinite or linked to a genuinely temporary need. Indefinite employment is common for continuing work, while temporary arrangements should reflect the actual nature of the task. The contract should identify the parties, duties, workplace, schedule, salary, payment method, and duration when relevant. Clear written terms reduce misunderstandings, although labor rights do not depend only on having a signed document. Employees are commonly paid a salario and receive pay records. Depending on the relationship, employment protections can include rest, annual leave, the year-end payment known as aguinaldo, social security coverage, and rules for ending employment. The employer normally registers an employee with the CCSS and handles employment-related contributions. This registration is different from a private insurance policy or a simple payment receipt. An independent contractor provides services with greater control over how the work is done. Calling a supervised employee an independent contractor does not necessarily change the true relationship. Employment can end through resignation, dismissal, agreement, or completion of valid temporary work. Notice, final payments, and other consequences depend on the facts and the reason for termination. The Ministry of Labor, known as the Ministerio de Trabajo y Seguridad Social, provides a public reference point for labor questions. Courts and other competent bodies can resolve disputes that the parties cannot settle.
