Housing in El Salvador

A home in El Salvador may be fully paid for and owned, owned while being paid in installments, rented, lent or granted free of charge, provided because of work, or held under another arrangement. Formal ownership normally requires a public deed and registration. Rental arrangements are governed mainly by the contract and the Ley de Inquilinato, the country's rental law. The Ministerio de Vivienda, or MIVI, handles housing policy, social housing, lotification, urban planning, and resettlement. The Fondo Social para la Vivienda, or FSV, provides mortgage financing and supports buying, building, extending, or transferring housing loans. The Centro Nacional de Registros, or CNR, including the Registro de la Propiedad Raíz e Hipotecas, records ownership, mortgages, and related certificates. FONAVIPO supports housing contributions and projects. Municipalities issue cadastral records, debt-clearance certificates, and local permits. ANDA manages public water and sewerage services, while SIGET regulates electricity and providers such as AES, DELSUR, and EDESAL supply electricity in their service areas. A buyer should obtain an extract certificate, a full registry certificate, registry searches, information on liens, and a certificate showing whether the seller has other registered property. The usual purchase sequence is a sale agreement, a public deed, and registration with the CNR. The buyer generally presents a DUI, the title documents, and the registration fee. A transfer tax may apply when the value exceeds US$28,571.43, subject to legal exceptions. Unregistered lots, missing deeds, incomplete lotification, and fraudulent documents create serious risks. A lotification may require MIVI registration or regularization under the applicable special law, followed by individual titling and CNR registration. A rental contract should be in writing and identify the parties, property, rent, and payment method. When no written contract exists, the landlord bears responsibility for that omission, while a verbal lease is harder to prove. The end of the stated rental period does not by itself require the tenant to leave if rent is being paid and no legal ground for ending the lease exists. If a landlord refuses to accept rent, the tenant can use a court deposit procedure within eight days. Residential rental disputes involving arrears, termination, unpaid rent, or rent increases can be handled through an abbreviated inquilinato proceeding under Articles 477 and 478 of the Código Procesal Civil y Mercantil, or CPCM, before the first-instance court serving the property's location. FSV access normally requires at least six months of contributions through an AFP, meaning an Administradora de Fondos de Pensiones, IPSFA, meaning the pension system for the armed forces, or another eligible system. Independent workers generally need two years of activity. Formal-income applicants are generally accepted from age 18 to 69, while variable-income applicants are generally accepted from age 18 to 60. Insurance, repayment capacity, good credit, and a Hacienda debt-clearance certificate are also relevant; the certificate is required for a sale or credit transaction of US$30,000 or more. The process usually starts with prequalification, followed by selection of a financing line and property, submission of documents, payment of the down payment or complement, assessment, decision, a payroll deduction order or preventive registration, and execution of the deed. Up to two applicants may apply together. FSV lines include new, used, and recovered housing, lots, individual construction, RAM, and debt transfers. For new housing priced up to US$40,000, formal-income financing can reach 100% at 4% for up to 30 years, while variable-income financing can reach 97% at 5% for up to 25 years. For prices from US$40,000.01 to US$61,000, financing can reach 98% for formal income and 92.5% for variable income, normally for up to 25 years. These conditions can change. Programs such as Casa Joven, Casa Mujer, Vivienda en Altura, Vivienda Cercana, Aporte y Crédito, Vivienda Social, and FONAVIPO-FSV serve different circumstances. Casa Joven covers applicants aged 18 to 29 and can finance up to 100% of the price or appraisal. A FONAVIPO contribution generally requires an owned and CNR-registered plot of no more than 600 square metres, a family group, income of no more than two minimum wages, and no previous housing contribution. MIVI's social-interest classification applies to housing priced up to US$100,156. No general housing allowance or universal rent subsidy from MIVI was documented in the September 2026 information reviewed. Construction and subdivision may involve MIVI feasibility review, road and zoning review, parceling or construction permits, and final acceptance. In municipalities without local plans, the indicative processing times are about 20 days for feasibility and 25 days for a permit, but local ordinances can change the procedure. The country is commonly divided for administrative planning into Occidente, Centro, and Oriente, and requirements can differ between departments and municipalities. A new ANDA water connection generally requires identity documents, a public deed or a lease with a promise to sell, a CNR certificate issued within the previous three months, a cadastral record, and a sketch. The inspection request costs US$13.56. ANDA may disconnect water after 60 days of non-payment. Electricity connections typically require a certified electrician and a technical inspection, with connection often taking three to six days. Water, sewerage, and electricity availability is not uniform across El Salvador. During occupancy, tenants should pay rent on time, use the property as agreed, retain receipts, and record the condition of the home in an inventory. The contract should state who pays each utility and who handles repairs. Owners should check municipal debt-clearance status, mortgage and insurance status, and CNR annotations. When a rental ends, the parties can arrange voluntary handover or a court-ordered eviction; arrears may lead to termination, eviction, and a claim for unpaid rent. Sale, donation, inheritance, and mortgage cancellation of owned housing normally require a deed and CNR registration. For FSV-financed housing, the mortgage remains relevant until it is formally cancelled. At handover, utilities should be closed or transferred and the parties should keep a signed record and payment evidence.
