Criminal law in Estonia

Criminal law in Estonia is mainly based on written penal legislation, including the Penal Code, called the Karistusseadustik. Conduct can be punished only when the law defines it as an offense. Estonia distinguishes crimes, called kuriteod, from misdemeanors, called väärteod. They differ in seriousness and may follow different procedures. Criminal responsibility normally depends on more than a harmful result. The legal definition, the person’s conduct, intent or negligence, and any defense or justification may all matter. Police and investigative bodies collect evidence, while the Prosecutor’s Office directs criminal proceedings and decides how prosecution should proceed. Courts decide guilt and punishment in contested criminal cases. A suspect or accused person has procedural rights, including the right to understand the allegation and defend against it. The presumption of innocence means guilt must be established through the lawful process. A victim may report an offense, provide evidence, receive procedural information, and seek protection or compensation where the law allows. The victim’s role is important but is different from the prosecutor’s public function. A case may involve questioning, searches, expert evidence, restrictions, pre-trial proceedings, and a court hearing. Some cases can end through a simplified or agreed procedure when legal conditions are satisfied. Penalties and other consequences depend on the offense and circumstances. The system aims to punish unlawful conduct, protect society, prevent further harm, and support lawful rehabilitation. Criminal proceedings can have serious effects on liberty, reputation, work, immigration, and family life. Early legal assistance and careful preservation of evidence are therefore especially important.
