Criminal law in Guatemala

Guatemalan criminal law identifies conduct that can be punished by the state and establishes possible legal consequences. The Constitution, Código Penal, and criminal procedure rules provide the main framework. The Policía Nacional Civil, commonly called PNC, performs public-security and investigative functions within its authority. The Ministerio Público, commonly called MP, directs criminal investigation and prosecution rather than acting as the final judge. Criminal courts supervise important procedural decisions and decide cases presented to them. Judges must assess lawfully produced evidence and respect constitutional guarantees. An accused person has fundamental protections, including legal defense, due process, and the presumption of innocence. A public defender may be available through the criminal public defense system when the applicable conditions are met. Victims can report suspected crimes and provide evidence. They may also seek information, protection, participation, or reparation through procedures allowed by Guatemalan law. A typical case can move through a report, preliminary investigation, judicial hearings, a decision on prosecution, trial, judgment, and possible review. Not every report reaches every stage because evidence and legal requirements shape what happens next. Evidence may include witness accounts, documents, communications, physical objects, medical findings, and expert analysis. Changing, hiding, publishing, or collecting evidence carelessly can harm safety, privacy, or the investigation. Arrest and pretrial restrictions are not criminal convictions. Anyone facing detention, questioning as a suspect, threats, or a serious accusation should obtain independent criminal defense promptly and avoid discussing the facts publicly.
