Labor law in Guatemala

Guatemalan labor law is mainly built around the Constitution, the Código de Trabajo, social security rules, and related regulations. Its purpose is to protect work while defining the rights and duties of workers and employers. An employment relationship generally depends on the real situation, not only the name of a document. Personal work performed under another person's direction in exchange for pay can have employment consequences even without a detailed written contract. A contract may address the job, workplace, schedule, salary, payment method, duration, and other conditions. Written terms make proof easier, but they cannot normally remove mandatory worker protections. Employers must pay agreed compensation and respect legal protections concerning working time, rest, leave, health, safety, and equal treatment. Workers must perform the agreed work with reasonable care and follow lawful workplace instructions. The Instituto Guatemalteco de Seguridad Social, commonly called IGSS, administers important social security programs for covered workers and employers. Registration and contribution records can affect access to benefits. Workers may organize unions, negotiate collectively, and use legally regulated collective procedures. These rights follow formal rules, especially when a dispute may lead to collective action. Dismissal, resignation, and the end of a fixed arrangement can produce different rights and payments. The reason for separation, length and form of the relationship, salary records, notices, and evidence are often important. Labor disagreements may first be discussed internally or presented to the labor authorities, labor inspection, or the labor courts. Delay, missing records, and signing a settlement without understanding it can weaken a claim.
