Family in Honduras

The Honduran family-law framework and family practice regulate marriage, de facto union (unión de hecho), legal parentage, parental authority (patria potestad), support, adoption, care, protection from violence, separation and inheritance matters. A de facto union may have a legal effect similar to marriage after recognition by the competent authority; relevant factors include legal capacity, a single existing partnership and a stable shared life. Actual access depends on documents, civil status, place of residence and the applicable procedure. The National Registry of Persons (Registro Nacional de las Personas) operates through the Municipal Civil Registry (Registro Civil Municipal). A birth is generally registered there free of charge within six months. A late or missing registration may require a free record replacement (reposición). Records and marginal annotations concerning birth, marriage, divorce, de facto union and death establish name, nationality and legal identity and facilitate access to school, health care and protection services. Legal parentage means the legal attribution of a child to their parents. Recognition may be voluntary, through a public instrument or will, or through court proceedings. Family courts and, for evidentiary questions, the Public Prosecutor's Office (Ministerio Público) and the Forensic Medicine Directorate (Dirección de Medicina Forense) may be involved; DNA evidence is handled through regulated forensic or laboratory procedures. Established parentage may affect name, parental authority, support and inheritance rights. Parental authority covers parental responsibility for care, upbringing, representation and protection. Family courts, SENAF and the public prosecutor's office may be involved in agreements, protection reports or court orders concerning custody and care (guarda y cuidado), communication and visits. Suspending or removing this responsibility does not end the duty to provide support. Protection measures may be required in cases of violence, exploitation or a risk to the child's welfare. Support includes, among other things, living expenses, housing, clothing, medical care and education. Depending on statutory requirements, support claims may be available to spouses, children, children with disabilities, parents, grandparents, adoptive parents or adopted children. For proceedings before the Family Court of First Instance (Juzgado de Letras de Familia), identity and birth records, expense information, witness statements and evidence of financial capacity are useful. An agreement may be possible; enforcement may include wage garnishment of up to 50 percent under the applicable rules, registration in the Register of Child Support Debtors (REDAM) and other legal consequences. The Public Defense Service (Defensa Pública) may assist qualifying people with low incomes. Adoption is a formal procedure with no informal legal substitute. The National System for Children, Adolescents and Families (SENAF) has been the responsible state body since 2024; older records may still refer to the former agency (DINAF). The procedure includes an eligibility assessment, documentation, a finding that the child is adoptable, required consents, selection of a suitable family, court approval, registration and follow-up care. An adoption is generally registered within 15 days after formalization; duration and costs depend on the assessment, court and registration procedures. Care in Honduras is often provided by extended family, households, neighborhoods, religious groups, health services or nongovernmental organizations. SENAF and the child-protection coordination system (SIGADENAH) coordinate child protection and alternative care pathways. The reviewed sources do not establish a single general long-term care benefit for all families. Support through the social security institution (IHSS) depends on insurance coverage and the applicable regime; social practice and legally enforceable duties therefore must be assessed separately. In cases of domestic or intrafamily violence, affected people may contact the National Police (Policía Nacional), the public prosecutor's office, the Women's Prosecutor's Unit (FEP-MUJER) or the Children's Prosecutor's Unit (FEP-NIÑEZ), specialized courts, the human-rights authority (SEDH), shelters or nongovernmental organizations. Depending on the danger, possible measures include a report, immediate safety measures, medical care, legal referral and criminal investigations. The Women's Prosecutor's Unit has nationwide jurisdiction; processing time and local assistance depend on the immediate danger and the responsible body. A divorce may be contested or by mutual consent. Court regulation of custody, contact, support and property is separate from registration of the divorce or dissolution of a de facto union with the competent municipal civil registry. Family obligations toward children continue regardless. After a death, a death registration, inheritance or estate proceedings, guardianship, a survivor's pension or a funeral assistance payment may be required; depending on the claim, responsible bodies include the National Registry of Persons, courts, municipal or health authorities, and IHSS or another insurance system.
