Criminal law in Italy

Italian criminal law is called diritto penale, and a criminal offence is called a reato. Written law defines punishable conduct and the possible legal consequences. Offences are traditionally divided into delitti and contravvenzioni. The classification can affect legal rules, but both categories belong to criminal law. Police bodies such as the Polizia di Stato and Carabinieri receive reports, protect people, preserve evidence, and investigate under legal authority. Local police and specialized forces may also act within their responsibilities. The public prosecutor, called the pubblico ministero, directs the criminal investigation. The relevant prosecution office is commonly the Procura della Repubblica. A person being investigated is an indagato, while a person formally facing a criminal accusation is an imputato. Guilt must be decided through the lawful process, and the defense has the right to challenge the accusation. A defense lawyer is called an avvocato difensore. Legal assistance is especially important during questioning, searches, detention, precautionary measures, and decisions about procedural options. A victim or injured person is commonly called the persona offesa. Reporting a crime may take the form of a denuncia or, for certain offences, a querela expressing the wish that authorities proceed. Evidence can include witness accounts, documents, messages, objects, medical findings, and technical examinations. Altering evidence or coordinating stories can seriously damage a case. Proceedings may include investigation, judicial review, trial, judgment, and appeal. Some cases can use alternative procedures, but their effects should be understood before any choice is made. Criminal proceedings can also include claims for harm caused by an offence. Safety, accurate records, confidentiality, and timely legal help are practical priorities for everyone involved.
