Labor law in Kazakhstan

Kazakhstan has a codified labor-law system. Its main rules are found in the Labor Code, while other laws regulate social protection, workplace safety, and certain occupations. An employment relationship normally begins with a written employment contract. The contract should identify the parties, workplace, job, pay, working conditions, and starting date. The actual facts may still matter if someone works under the employer’s direction without proper paperwork. Employment contracts may be indefinite or fixed-term when the law permits that form. A probation period can be agreed for suitable roles, but it should be written into the contract. Employers generally record employment information through the official labor-information system. Employees have rights concerning timely pay, rest, annual paid leave, safe working conditions, and equal treatment. Employers may issue internal workplace rules and lawful instructions, but these cannot remove mandatory protections. Working time is organized through schedules, time records, rest periods, weekends, and leave. Overtime, night work, and work on rest days receive special treatment. Some employees, including minors and people in protected situations, have additional safeguards. Employment may end by agreement, expiry of a lawful fixed term, resignation, employer dismissal, or another recognized ground. The employer must use the correct ground, documentation, and procedure. Some dismissals require advance steps or special protection checks. Collective agreements and trade unions can supplement individual contracts. Labor disputes may pass through workplace conciliation procedures and then a court, depending on the dispute and applicable rules. Written evidence is central in practice. Keep the contract, job description, payslips, schedules, leave requests, warnings, medical or safety records, and every notice about termination.
