Art in Malawi

The Ministry responsible for culture works through the Department of Arts, including its Arts and Crafts Division and Censorship Division. The National Cultural Policy 2018 and the National Arts and Heritage Act 2024 provide the main public framework. The 2024 Act provides for a national arts and heritage council, a National Arts and Heritage Promotion Fund, and registration or regulation of artists, associations, creative enterprises and event organisers. Fund regulations have been developed and validated, but full operational capacity, regular funding and established grant rounds are still developing. The Copyright Act 2016 has been largely in force since 13 March 2017. It protects original literary, dramatic, musical, artistic and audio-visual works, sound recordings, broadcasts, architectural works, photographs, applied art and computer programmes from creation. Owners may control reproduction, distribution, display, performance, public communication, translation and adaptation, and creators retain moral rights. Folklore protections also cover community expressions such as folktales, poetry, songs, dances, rituals, carvings, pottery, textiles, metalwork, jewellery, baskets, costumes and traditional instruments. The Copyright Society of Malawi, known as COSOMA, is the statutory copyright organisation. It registers works and associations, licenses uses, collects and distributes royalties, and supports authors, performers, producers and publishers. Broadcasters, DJs, libraries and other users may need a COSOMA licence before using protected material. Registration and fees depend on the activity; copyright protection itself does not generally begin only after registration. Visual art includes fine art, crafts, carving, pottery, textiles, metalwork and activities described locally as Art in the Park. Artists commonly work through informal practice, collectives, exhibitions, associations, cultural centres and apprenticeships. The Visual Arts Association of Malawi, the Department of Arts, COSOMA and the University of Malawi support different parts of this field. Blantyre Cultural Centre is a bookable venue, and Kungoni Art Gallery and Show Room is a non-state example. Malawi has no verified uniform national public-gallery system, fixed exhibition tariff or universal artist grant programme, so venue access and participation costs must be checked for each activity. Music and performing arts combine community transmission, informal apprenticeship, formal coaching and association-based work. Traditional forms include Mwinoghe, Gule Wamkulu, Vimbuza, Tchopa and Mbira or Sansi practice. The Department of Arts, the Musicians Union of Malawi, COSOMA, the University of Malawi, the National Theatre Association of Malawi and the Malawi Folk, Dance, Music and Song Society serve different functions. Public performance, broadcasting and streaming can involve musical-work, performer and sound-recording rights, so permissions and licensing should be checked separately for the composition, performance and recording. Literature includes novels, stories, poetry, plays, scripts and essays in English, Chichewa and other local languages. Writers, publishers, libraries and the University of Malawi form the main support network. The Malawi Writers Union, Book Publishers Association of Malawi, COSOMA and the National Library Service are relevant institutions. The National Library Service provides a nationwide public library and information service under the 1967 Act. Its reported membership fees are K2,500 for an urban or town adult, K500 for an urban or town junior, K500 for a rural adult and K100 for a rural junior. Film follows a more formal approval process than many other art activities. A script or trailer can be submitted through the current digital process for account creation, fee payment, review, classification and a decision. The Malawi Censorship Board uses the classifications U, A, AA 14+, X 18+ and Rejected. Public exhibition requires classification and certification, and the current digital submission process does not yet support full-video upload. The Department of Arts, Film Association of Malawi and COSOMA also have roles in the film sector. Architecture is professionally regulated when the work enters architectural practice. The Board of Architects and Quantity Surveyors and the Malawi Institute of Architects oversee the professional pathway. An architect generally needs an approved qualification, a qualifying examination and at least two years of practical training unless an accepted qualification provides an alternative. Registration categories also include Graduate Architect and Architectural Technician, and annual fees are due by 31 March. This professional regulation concerns the built-environment practice; the art scope covers the aesthetic and design creation itself. Design includes applied art, fashion, textiles, graphic work and handcraft. The University of Malawi, the Department of Arts, COSOMA and the Arts Production and Marketing Cooperative support different pathways through study, enterprise, exhibitions and markets. Copyright may protect an original design, while trademarks, business registration and other intellectual-property questions require separate checks. Photography is supported by formal study, associations and freelance commissions, and photographs qualify as artistic works; reproduction, display and public communication should follow the creator's permission or licence terms. Digital art remains mainly informal and emerging. Artists may work independently, study art, design, film or photography, and publish online. Copyright covers electronic reproduction and storage, public communication, computer programmes, compilations and audio-visual works, but platform terms, commissions and licences can change the practical position. No dedicated national digital-art body has been verified. The Department of Arts, COSOMA and relevant University of Malawi programmes provide the closest documented institutional connections. The Department of Monuments and Museums supports heritage collections and conservation, but it should not automatically be treated as a national contemporary-art gallery. Arts cooperatives and an Arts SACCO provide additional collective and enterprise pathways, while the National Arts and Culture Centre project has not been verified as operational.
