Consumer protection in Mexico

Consumer protection in Mexico is governed mainly by the Ley Federal de Protección al Consumidor. It applies to many transactions between consumers and suppliers of goods or services. The law supports clear information, fair treatment, respect for advertised conditions, and remedies when a supplier fails to meet legal or contractual duties. The exact remedy depends on the product, service, contract, and facts. PROFECO, the Procuraduría Federal del Consumidor, receives consumer matters and can help with conciliation and other enforcement functions. It is not a general court for every type of dispute. A queja is generally an individual complaint seeking a solution to a specific transaction, such as repair, replacement, refund, or compliance. A denuncia informs the authority about a business practice that may affect consumers more broadly. Useful proof includes receipts, invoices, warranties, advertisements, order confirmations, contracts, photographs, delivery records, and written messages. The supplier’s name and contact details are also important. Consumers should first describe the problem clearly and ask the supplier for a written solution when that is safe and practical. A calm written request often shows what was promised and what remedy is sought. Some sectors have additional regulators or special complaint systems, including areas such as financial services, telecommunications, transport, or health. The correct institution depends on the transaction. Consumer protection has limits. It does not guarantee satisfaction with every purchase, replace normal contract analysis, or solve disputes where the real issue is a separate criminal, civil, employment, or regulatory matter.
