Romantic relationship in Mongolia

Mongolian terms such as Үерхэл нөхөрлөл, хайр дурлал, романтик харилцаа and хос describe dating, love, romantic relationships and couples. National evidence does not establish one typical way to meet, use dating applications or define relationship duration, so practices should not be treated as uniform across Mongolia. Guidance from the National Human Rights Commission addresses respect, equal participation, boundaries, rejection, consent and long-term commitment as relationship skills rather than as a state dating procedure. Under Mongolia's Family Law, marriage is a voluntary and equal union between a man and a woman. Both people generally need to be at least 18 years old, give mutual consent and meet the legal conditions for registration. Existing marriage, underage status, close kinship, certain dependency or support relationships and adoption-related restrictions can prevent registration. Applicants submit separate applications, identification or passports and a medical certificate that includes counselling on genetics and family planning. Adult witnesses are required. A state civil registration authority or a diplomatic mission records the marriage, normally within a maximum of five working days. Legal rights and duties as spouses begin with registration. Marriage gives spouses equal rights and duties concerning residence, occupation, family planning, joint property and compensation for harm. It also creates duties of fidelity, care, respect, support and financial contribution to the family, and the law prohibits violence. A couple living together without marriage may be described as хамтран амьдрагч. Domestic-violence law expressly covers cohabitants, divorced spouses and people who share a child even when they no longer live together. This protection does not automatically give cohabitants the same marital, property, inheritance or migration rights. Domestic violence can be physical, sexual, psychological or emotional, economic or controlling. A 2017 national study of more than 7,000 women found that among ever-partnered women, 57.9% reported some partner violence during their lifetime, 31.2% physical and/or sexual violence during their lifetime, and 35.0% some partner violence in the previous 12 months. These figures describe the surveyed women and are not a prevalence rate for every relationship in Mongolia. A report can be made to the police at 102 or to the governor of a soum, bagh or khoroo. A third party may also report suspected domestic violence. Authorities should protect confidentiality, assess risk, arrange emergency medical care and document injuries; the police may arrest a person or remove weapons when the circumstances justify it. Police can refer the case to a social worker. One-stop service centres, called нэг цэгийн үйлчилгээний төв, and temporary shelters, called түр хамгаалах байр, provide support through state or NGO providers in aimags, soums, districts and the capital. Shelter addresses are confidential, and costs follow the applicable public or provider rules. Police materials list 107 for domestic-violence advice or reporting, but local availability should be checked because a transition to 112 may affect the number in use. Marriage may end through an administrative process when both spouses agree, have no child under 18 and have no property dispute. The registration authority can examine and decide that application within a maximum of 30 days; the end of the marriage must be registered within a statutory maximum of 21 working days. Other cases go to court. Courts generally consider reconciliation and may pause proceedings for up to three months, except where continuing serious violence has been proven. After a court decision, civil registration should record the change within one working day. Questions about children, support and joint property may require court proceedings or mediation. Mongolian law uses gender-specific marriage rules. Same-sex marriage, registered partnership and equivalent cohabitation rights are not recognised according to the cited human-rights reporting, and equal access to marriage-related benefits is not established. Reports also document discrimination and violence affecting LGBTQI+ people. These legal and safety differences should be considered separately from the ordinary question of how a couple describes its relationship.
