Living together in Congo Republic

Congo Republic has formal rules for equality, freedom of movement, property, religion, expression, information, peaceful assembly, association and petitions. The Constitution protects people from discrimination based on origin, ethnicity, social status or political or religious convictions, supports Indigenous Peoples and provides for equality between women and men, including representation. Ethnic hatred and incitement to violence are punishable. Public demonstrations are subject to legal and public-order requirements and require written notice to the responsible administration. A person or group may submit an individual or collective petition, and the authority should answer within three months. Local administration operates through departments, communes, arrondissements, districts, urban and rural communities, quartiers and villages. Law 3-2003 establishes proximity administration and local democracy, while Law 7-2003 regulates the organisation and functioning of local authorities. Responsibility can therefore differ between national, departmental and municipal bodies. Mairies, prefectures, district or quartier authorities and village-level leaders may each have a practical role in a local matter. There is no nationally uniform mandatory mediation process, fee or maximum processing time for everyday disputes. A disagreement may first be discussed with neighbours, community leaders, customary or religious chiefs, an NGO, church representatives or a local dialogue committee. Depending on the seriousness and location, the matter can then move to a mairie or prefecture, the police or gendarmerie, and ultimately a court. Evidence from Pool shows dialogue activity in 13 districts and two communes de plein exercice, including 15 local dialogue and reconciliation committees. These initiatives have addressed security, socioeconomic development, political tensions, the return and integration of former combatants, non-stigmatisation and the restoration of public services, but their formal status as a nationwide standard is not established. Diversity and inclusion also depend on local access. The CNAR and national systems support refugee and asylum matters, while UNHCR and other partners assist without replacing state authorities. In August 2024, UNHCR reported assisting 68,726 people, including 34,419 from the Central African Republic, 30,506 from the Democratic Republic of the Congo, 3,186 from Rwanda and 615 from other countries. Village chiefs help distribute verification information, and host-community inclusion can use shared services and groups. Documents, rural distance and delays in refugee-status procedures can make access unequal. Public-space coexistence is especially relevant because more than half of the population lives in Brazzaville and Pointe-Noire, while about half of the urban population lives in informal or precarious quartiers. Roads, markets, water, sanitation, waste, flooding and safety commonly shape local disputes and planning questions. The country has no single nationwide public-space use regulation, fee schedule or complaint deadline identified in the available research. Digital coexistence is likewise uneven: ITU data for 2024 reports internet use of 47.3% and household internet access of 55.9%, with a marked urban-rural difference. Freedom of communication is constitutionally protected, but hate speech, incitement to violence and public-order limits remain relevant; no national digital-coexistence code or uniform reporting platform was identified. People can participate through associations, petitions, peaceful assembly, local dialogue platforms, NGOs, churches and women’s, youth or community leaders. No universal municipal participation office, fee or response deadline is established. In shared housing, the relevant coexistence questions concern privacy, noise, hygiene, visitors, safety and common rooms; housing supply, rent and tenancy law belong to the separate housing subject.
