Labor law in Vietnam

Labor law in Vietnam is mainly organized through the Labor Code and related rules. It applies to many employees and employers, while special rules can apply to public officials, foreign workers, domestic workers, and some other groups. The central document is the employment contract, called hợp đồng lao động. It normally identifies the work, workplace, contract period, pay, working conditions, and the main duties of both sides. A written contract makes it easier to prove what was agreed. The system covers wages, working time, rest periods, public holidays, annual leave, probation, workplace safety, and protection against discrimination or unfair treatment. Social insurance, commonly called BHXH, and related insurance systems are connected to employment but may have their own procedures. Employers usually organize work through company policies and internal labor rules. Employees are expected to follow lawful instructions, protect company property, and respect safety and confidentiality duties. Employers must manage work lawfully and keep required employment records. Employment can end through agreement, expiry of a fixed term, resignation, dismissal, redundancy, or other legally recognized reasons. The correct notice, process, and payments depend on the reason for ending the employment and the contract type. A workplace dispute may first be handled through discussion or an internal complaint. Depending on the issue, a labor mediator, a labor arbitration council, or a People's Court may become involved. Evidence such as contracts, payslips, attendance records, messages, and termination notices can be decisive. The practical meaning is simple: read before signing, keep copies, record important events, and ask for help when the employer or worker does not follow the agreement. Legal protections exist, but they are easier to use when the facts and dates are clear.
