Consumer protection in Belgium

A consumer is generally an individual acting mainly outside a trade, business, craft, or profession. A seller or service provider acting professionally has stronger information and conduct duties. Before a purchase, the trader should provide essential information clearly. This commonly includes the product or service, total price, important conditions, and the trader's identity. Belgian rules prohibit misleading and aggressive commercial practices. Advertising should not hide essential facts or pressure consumers unfairly. Contract terms must be understandable and must not create an unlawful imbalance against the consumer. A signed term is not automatically enforceable merely because it appears in standard conditions. Goods should match the contract and work as a consumer may reasonably expect. If they do not, legal remedies may include repair, replacement, price reduction, or ending the contract, depending on the circumstances. Online, telephone, and other distance contracts often come with added information duties and a possible withdrawal right. Exceptions exist, so consumers should check the nature of the purchase before relying on cancellation. A commercial warranty is an extra promise made by a trader or producer. It does not automatically replace the consumer's legal rights against the responsible seller. The normal first step after a problem is a clear complaint to the trader. Evidence such as the order, receipt, description, photographs, correspondence, and payment record helps show what was agreed. If direct discussion fails, a consumer may consider a competent complaint body, mediation, alternative dispute resolution, or court proceedings. The suitable path depends on the trader, sector, value, and desired remedy.
