Immigration law in China

China's immigration system is commonly described through exit and entry administration, or 出入境管理. It is administered by immigration, public security, foreign affairs, and other authorities according to their separate functions. A visa is normally obtained for a particular purpose before entry, unless an applicable exemption or other arrangement applies. Common purposes include tourism, family visits, study, business activities, and work. Entry permission, lawful stay, residence permission, and work authorization are related but distinct. A passport and visa alone do not automatically authorize employment in China. Foreign nationals staying for longer periods may need a residence permit linked to work, study, family, or another accepted basis. The supporting host, school, employer, or family relationship often remains important throughout the stay. Foreign employees normally need both work authorization and the appropriate immigration status. Changes of employer, occupation, location, study status, or family circumstances may require official action before the change takes effect. Foreign nationals must comply with local accommodation registration requirements. Hotels commonly handle registration for guests, while people living elsewhere may need to ensure that registration is completed through the local process. Overstay, unauthorized work, false information, or activity inconsistent with the permitted purpose can lead to administrative consequences. Serious cases may affect detention, departure, future entry, or the sponsoring organization. Permanent residence exists but is different from citizenship and ordinary temporary residence. Chinese nationality law is restrictive toward dual nationality, so nationality questions require careful individual assessment. Immigration outcomes depend heavily on complete documents and consistent facts. Passports, official forms, employer or school records, family documents, health records, and authenticated foreign documents may all become relevant.
