Employer in Cuba

An employer, or empleador, is the person or organization legally responsible for an employment relationship. A supervisor may direct daily work without being the legal employer. Many Cuban employers belong to the public sector. Ministries, public institutions, and state enterprises perform different functions, but each workplace should be able to identify the entity responsible for the worker. The private sector includes authorized businesses such as micro, small, and medium-sized enterprises, commonly known as MIPYMES, as well as individual operators and other permitted actors. Cooperatives and agricultural producers may also engage workers under their applicable arrangements. Before hiring, an employer should define the role and check any required identity, qualifications, health conditions, or authorization. The employer should use the correct document rather than describing employment as an unrelated private favor or informal service. The employer sets lawful duties, schedules, workplace procedures, and supervision. It must also explain compensation, keep reliable records, and provide the worker with appropriate employment documentation. Workplace safety is a central responsibility. The employer should identify hazards, provide suitable instructions and protective measures, and record and respond to accidents. Employers also manage attendance, leave, discipline, training, and changes in work organization. Decisions should be consistent, documented, and communicated in a way the worker can understand. An employer may face practical limits from supplies, transport, energy, financing, or administrative procedures. These difficulties may affect operations, but they do not make unclear hiring or missing payment records safe for workers. A responsible worker or business partner should verify the employer’s full legal name, sector, authority to operate, and person authorized to sign. This prevents confusion when a workplace uses a popular trade name that differs from its legal identity.
