Romantic relationship in Madagascar

Courtship in Madagascar has no direct national dating registry or single dating-service system. Couples usually form relationships through informal personal, family, community or religious pathways. Schooling, employment, poverty, social status and avoiding pregnancy can influence when and how a relationship develops. A 2006 survey of students in Antananarivo, published in 2013, found that premarital abstinence was an ideal for young women and men, with stronger pressure on girls and some reported condom use by boys. This limited and older study does not describe current relationships across Madagascar. Regional customs differ substantially. Fafy may involve family permission or blessing together with the transfer of zebu. Moletry can refer to a parent-arranged customary union involving didin-karena, such as zebu or money. Volambita can describe a temporary one-day union. These practices are community- and region-dependent and do not establish one national relationship pattern. Civil marriage is available from age 18 for both sexes. A person under 18 needs serious grounds, authorization from the Tribunal de Première Instance and consent from the parents or guardian as well as the young person's own consent. Personal consent is required, forced consent is invalid, bigamy is prohibited and certain family relationships prevent marriage. The legal marriage model is between a man and a woman; Madagascar does not recognize same-sex marriage or civil unions. Same-sex intimacy is criminalized below age 21, and comprehensive protection against discrimination based on sexual orientation or gender identity is not in place. A traditional ceremony can be verified by the Chef de Fokontany, the head of the local administrative unit. The parties' consent is recorded in a procès-verbal and the record should be transferred to the civil registrar within a maximum of 12 months. Without a marriage act, the traditional ceremony has no civil effects. A marriage certificate is called a sora-piankohonana, while a family record book is called a bokim-pianakaviana. A commune may require copies of birth records and other documents. A marriage dossier is commonly prepared 15 to 20 days before the ceremony. Registration itself has no fee according to the UNICEF civil-registration profile, but certificates and local services can involve variable charges. Local ceremony fees are reported at about 10,000 to 40,000 Ariary and sometimes up to 60,000 Ariary, depending on the commune and day; the current tariff must be checked locally. Marriage establishes a jointly fixed residence and mutual duties of fidelity, secours, assistance and respect. Spouses contribute to household costs according to their means and share responsibility for childcare and education. The husband is named Chef de famille, while both spouses jointly administer the family's material and moral affairs. Under Zara mira, the statutory community-property regime, jointly acquired property is generally presumed to belong half to each spouse unless contrary proof exists. Cohabiting couples may share a household without marriage, but their documented civil protection and property position are weaker or uncertain, so registration is a significant safeguard where formal rights are needed. Law No. 2019-008 covers domestic violence and rape, including rape by a spouse. Enforcement resources remain limited, shelters are few and family or community pressure can push survivors back to a partner. The 2021 DHS/INSTAT estimate found that about four in ten women who were currently or formerly in a union had experienced physical, emotional or sexual violence by a husband or partner. Support can include a CECJ, meaning a Centre d'Ecoute et de Conseil Juridique, a CPCI or integrated gender-based-violence centre, the Police Brigade Feminine, emergency number 113 and the Police Nationale online gender-based-violence reporting portal. Centre Vonjy provides integrated medical, psychosocial and legal support mainly for people under 18, while access remains uneven in rural and remote areas. Sexual and reproductive health services include contraception through health facilities, mobile clinics and midwives. In 2021, 43% of women aged 15 to 49 in unions reported using a modern contraceptive method, 7% used a traditional method and 15% had an unmet family-planning need. The finding that 31.1% of girls aged 15 to 19 had started childbearing is an indicator of early family formation, not a measure of relationship prevalence. Cost, distance and gender expectations can restrict access. A woman may use misintaka, the statutory temporary separation pathway, to leave a marriage for serious grounds for up to two months and stay with parents, relatives or a gender-based-violence centre. The husband is expected to pursue Fampodiana, a return or reconciliation process, and marital duties continue during this period. This gendered rule is not a general legal right to end any romantic relationship. Divorce is handled by the Tribunal de Première Instance when a serious breach makes continued cohabitation intolerable; adultery is sufficient grounds. Optional conciliation can take place before court through the Chef de Fokontany, the mayor or a delegate. The court summons the parties for conciliation within 15 days and may adjourn the case for up to six months. Separate residence, provisional maintenance and custody measures may be ordered, and the judgment should be transcribed within one month. A registered traditional marriage can also be dissolved through divorce. No reliable national divorce tariff is available, so court and representation costs depend on location and circumstances.
