The Constitution of the Independent State of Samoa 1960 establishes the country's constitutional order. Samoan and English are authoritative languages, with English prevailing if the texts conflict. Constitutional rights include life, liberty, a fair trial, religion, speech, assembly, association, movement and residence. Parliament may restrict these rights by law for purposes such as national security, public order, health, morals or the rights of others, subject to constitutional limits. The Fono Aoao Faitulafono is Samoa's unicameral Parliament. It includes the Head of State and members from 51 constituencies. Parliament makes laws, approves appropriations, scrutinises the executive and represents constituencies. It elects the Head of State for a five-year term. Parliamentary committees examine subjects such as finance, constitutional offices, social services, economic policy and infrastructure. The public may attend parliamentary sittings and make submissions to committees where the relevant process allows. Executive power operates through the Head of State, the Prime Minister and Cabinet. The Head of State appoints a Prime Minister who can command the confidence of Parliament. The Prime Minister leads Cabinet, and Cabinet ministers are appointed on the Prime Minister's advice and remain collectively responsible to Parliament. The Cabinet Secretariat supports central coordination. The Office of the Attorney-General provides the Government's principal legal advice, drafts legislation, conducts government civil litigation and undertakes criminal prosecutions. Samoa's judiciary is independent. The court system includes the Supreme Court, Court of Appeal and District Courts, while the Land and Titles Court deals with customary land, matai titles and Samoan custom. The Ministry of Justice and Courts Administration supports court administration, access-to-justice services, schedules and court fees. Court service points include Mulinuu and Tuasivi. Customary authority and court jurisdiction are not interchangeable: the Constitution and legislation define the legal limits of village and customary institutions. Samoa has 11 traditional and political districts, called itūmālō: A'ana, Aiga-i-le-Tai, Atua, Fa'asaleleaga, Gaga'emauga, Gagaifomauga, Palauli, Satupa'itea, Tuamasaga, Va'a-o-Fonoti and Vaisigano. The country also consists of villages, or nuu, including nuu mavae and non-traditional villages, and 51 electoral constituencies. No separately elected municipal tier is evidenced in the reviewed national structure. Local administration combines line ministries with the fa'amatai system, the fono a matai, village representatives such as the Pulenu'u and Sui o le Nuu or Sui o le Malo, and District Councils. The Village Fono Act 1990 places aspects of village authority under central-law oversight. The District Development Programme links district planning, public investment and service delivery. For financial year 2025-2026, the programme was listed at $91.8 million, with $1.8 million allocated per district. Forty-eight districts had initial funding agreements, and the initial disbursement was 70 percent. Twenty percent of District Development Programme funding is assigned to gender equality, disability and social inclusion initiatives. These formal programmes operate alongside customary decision-making and local community structures. Central administration includes ministries, constitutional authorities, statutory bodies and state-owned enterprises. The Public Service Commission is the constitutional authority for public-service human-resource management, workforce planning, recruitment and appointments, ethics, performance and monitoring. Public-service appointment confirmations are published through Official Circulars, and the stated appeal window is 14 days. Practical access to government services is concentrated in Apia but also reaches communities through Tuasivi, district and village channels. The One Government Portal brings together services such as civil registration, passports, tax and business services, driver and vehicle matters, police clearances, utilities and weather information. The Ministry of Finance leads public financial management under the Public Finance Management Act 2001. Samoa's financial year ends on 30 June. The annual process includes the Budget Address, Estimates, Fiscal Strategy, parliamentary appropriation and, where needed, Supplementary Estimates. The fiscal strategy covers revenue, departmental spending, debt management and a three-year forward projection. The Ministry of Finance manages cash flow, payroll, public accounts, quarterly reporting, debt bulletins and fiscal oversight of state-owned enterprises. The latest listed Public Accounts are for 2023-2024; the third-quarter report for financial year 2025-2026 covers July 2025 to March 2026 and is unaudited. Procurement includes the National Tenders Board, while revenue and customs functions are handled by separate government agencies. The Samoa Audit Office is an independent constitutional auditor. It examines ministries, public bodies, projects, annual public accounts and areas such as performance, the environment and information technology, and reports to Parliament. The Ombudsman, called the Komesina o Sulufaiga, handles complaints about maladministration, serves as Samoa's national human-rights institution and investigates abuse by enforcement agencies. Complaints can be submitted in writing, by email, by post or at the office, and complaint boxes are available at police stations and Vaiaata Prison. Handling times depend on the case. Parliamentary committees, the Office of the Attorney-General and the Public Service Commission provide additional forms of scrutiny, while the Office of the Regulator regulates telecommunications, broadcasting, postal services and electricity. Samoa's public sphere includes constitutional rights of speech, assembly and association. Parliament publishes Bills, Acts, Regulations, Hansard and Samoan-English translations. The Public Records Act 2011 governs the retention and access of public records, but the reviewed structure does not establish it as a general freedom-of-information system; access may be deferred for reasons such as national security or confidentiality. The Office of the Regulator also handles licensing, spectrum, tariffs, universal access and consumer complaints in the sectors within its authority. Samoa has no military force. Its sovereign security functions rely on the Samoa Police, Prisons and Corrections Services, including its maritime wing, and on national emergency and disaster institutions. Police functions include maintaining law and order, protecting life and property, preventing and investigating crime, traffic control, prosecutions and corrections. Emergency contact numbers are 911 and Police Headquarters 22222. The National Security Policy 2024 covers sovereignty, public institutions and infrastructure, human security, environmental and resource security, maritime security, transnational crime, cyber risks and disaster resilience. The Ministry of Natural Resources and Environment's Disaster Management Office, the National Disaster Council, the Disaster Advisory Committee and the National Emergency Operations Centre operate under the Disaster and Emergency Management Act 2007. Access to public institutions is not governed by one universal fee or deadline. Requirements, documents, fees and processing times depend on the responsible agency, court, complaint procedure or service. Formal government procedures and customary village pathways can both affect a practical outcome, but they have different legal bases and different limits.
