Romantic relationship in Syria

Romantic relationships in Syria may involve dating, family-mediated introductions, direct partner choice or engagement arrangements. Social expectations differ considerably by religious community, gender, urban or rural setting, displacement and local authority. No separate state-recognized legal status for an unmarried romantic relationship has been established beyond the formal systems connected with engagement, marriage and separation. Khitbah means engagement. It is socially established, but it is not itself a marriage contract and does not automatically create marital rights or duties. The marriage contract is called عقد زواج or عقد قران. Under the Syrian Personal Status Law of 1953, as amended in 2019, the general marriageable age is 18 for both parties. A court may authorize a marriage at ages 15 to 17 when the legal conditions are met, including claimed physical maturity, ability to understand marital rights and knowledge of those rights. Consent by the woman is a basic condition, and a forced guardian marriage can be challenged. The role of a father or grandfather as guardian and other conditions depend on the applicable personal-status rules. Muslim personal-status rules are not automatically transferable to every religious community. Muslim polygyny remains legally possible under conditions that include judicial review, a legitimate reason and the ability to provide maintenance. Parties may also record agreed contractual conditions in the marriage contract. A couple should verify the rules applied by the competent personal-status or religious court for their religion and location. The formal process normally runs through the competent personal-status or religious court and then Civil Affairs and the civil registry. The marriage certificate and family booklet provide documentary evidence. An unregistered religious marriage, known as زواج عرفي, can leave the couple with weak proof of the relationship and may require later court confirmation followed by Civil Affairs registration. It can complicate birth and family registration and increase vulnerability to abandonment, violence and loss of financial support. National costs and processing times are not reliably established and can vary by territory, status and documents. A registered marriage can create rights and duties connected with مهر, maintenance, residence or support, and later custody and family-record consequences. Unmarried cohabitation has no documented automatic state status or automatic marital rights. Violence in intimate relationships can be physical, sexual, emotional, psychological or economic and may occur at home, in public or through digital channels. Phone or social-media harassment, image blackmail, controlling behavior and restrictions on movement have been reported. Risks are especially serious for adolescent girls, displaced or returning people, women-headed households, widows, divorced women, people without documents and households affected by poverty or insecurity. Stigma and retaliation can reduce reporting. UNFPA and partner organizations provide services such as women and girls safe spaces, gender-based-violence case management, psychosocial support, sexual and reproductive health care and legal advice. UNHCR legal aid is reported as free for supported Syrian internally displaced people, returnees and host-community members in 14 governorates through the Syrian Arab Red Crescent, Syrian Development Organization, legal or community centers and mobile teams. Services can include advice or representation before courts and Civil Affairs for marriage or divorce registration, custody, alimony and domestic violence. Hotline and center access is reported for Sunday to Thursday from 9:00 to 15:00, but the current provider and local availability should be verified. Foreign refugees and asylum seekers generally need a valid residence permit for regular access to courts or the civil registry. Separation may involve talaq, khul' or court-ordered تفريق for reasons such as serious discord or violence. Registration follows the relevant court and authority process, including where an unregistered marriage or divorce already exists. Custody, maintenance, identity documents and personal safety often become the central practical issues after separation. Divorced and widowed women may face stigma, control, pressure to remarry and economic or sexual exploitation. Since local authorities and procedures have changed across Syria, the responsible office should be confirmed in the relevant governorate before relying on a previous procedure.
